Vendor Terms & Conditions
Event Date: October 3, 2026
Event Location: New Egypt Historical Society Museum Grounds
125 New Egypt Allentown Road, New Egypt, NJ 08533
By submitting payment and participating as a vendor at Phantom Fest, all vendors agree to the following terms and conditions:
1. Event Overview
Phantom Fest is an outdoor community event presented through a collaboration between Third Eye Event Productions and the New Egypt Historical Society. Vendors are responsible for maintaining a professional, safe, and respectful presence throughout the duration of the event.
2. Vendor Space
Vendor spaces are assigned by event management. Space assignments are final and may not be transferred, shared, or subleased without written approval from event organizers.
Vendors are responsible for providing their own:
Tables
Chairs
Tents/Canopies
Displays
Signage
Extension cords (if approved for electrical access)
3. Setup and Breakdown
Vendors must complete setup during designated setup hours and be fully operational before the event opens to the public.
Early breakdown is strictly prohibited. Vendors who leave before the event concludes may be prohibited from participating in future events hosted by Third Eye Event Productions.
All vendors are responsible for removing their merchandise, displays, trash, and personal property upon departure.
4. Weather Policy
Phantom Fest is a rain-or-shine outdoor event.
Vendors acknowledge that weather conditions may include rain, wind, heat, cold, or other natural elements. Vendors are responsible for securing their own tents, displays, merchandise, and equipment.
Event organizers reserve the right to modify event operations, relocate vendors when possible, delay opening, or cancel portions of the event if severe weather creates unsafe conditions.
5. No Refunds or Exchanges
ALL VENDOR SALES ARE FINAL.
No refunds, credits, transfers, exchanges, or rollovers will be issued for any reason, including but not limited to:
Inclement weather
Vendor cancellation
Travel issues
Personal emergencies
Equipment failures
Low attendance
Event schedule changes
By purchasing a vendor space, vendors acknowledge and accept these risks.
6. Electrical Access
Electricity at the venue is extremely limited and is not guaranteed.
Vendors should assume that electrical service will NOT be available. Vendors requiring power should make their own arrangements, such as battery-powered equipment, where appropriate and permitted.
No refunds will be issued due to the lack of available electrical service.
7. Permitted Merchandise
Event organizers reserve the right to prohibit the sale or display of any item deemed offensive, illegal, unsafe, discriminatory, hazardous, or otherwise inconsistent with the family-friendly nature of the event.
The sale of counterfeit merchandise, illegal items, weapons prohibited by law, controlled substances, or any unlawful products is strictly prohibited.
8. Liability and Indemnification
Vendors participate at their own risk.
Third Eye Event Productions, the New Egypt Historical Society, event staff, volunteers, sponsors, and venue representatives shall not be held liable for:
Personal injury
Theft
Property damage
Lost merchandise
Weather-related losses
Acts of God
Vendor equipment failures
Any other loss or damage arising from participation in the event
Vendors agree to indemnify and hold harmless Third Eye Event Productions, the New Egypt Historical Society, their officers, members, volunteers, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from the vendor’s participation.
9. Conduct
Vendors are expected to conduct themselves professionally and respectfully toward attendees, staff, volunteers, and fellow vendors.
Event organizers reserve the right to remove any vendor without refund for:
Disorderly conduct
Harassment
Unsafe behavior
Violation of event policies
Failure to comply with instructions from event staff
10. Acceptance of Terms
Submission of payment and participation in Phantom Fest constitutes acceptance of all terms and conditions outlined herein.
Event organizers reserve the right to amend these terms as necessary to ensure the safety and success of the event.
